Description
The Oxford Handbook of International Environmental Law takes stock of the major developments in international environmental law, while exploring the field's core assumptions and concepts, basic analytical tools, and key challenges. It is intended to serve as an authoritative and indispensable overview of the field. Although the Handbook focuses on international environmental law, it also examines the subject from a broader policy and theoretical perspective, drawing on insights from other disciplines such as political science, economics, and philosophy. It aims to strike a balance between practical preoccupations and critical or theoretical reflection. Each chapter examines an issue that is central to current scholarly debates or policy development. At the same time, the Handbook is structured as a whole to provide readers with both a 'bigger picture' of international environmental law and a more in-depth understanding of its preoccupations. This approach is particularly important at a time in the development of international environmental law when its fragmentation into increasingly specialized sub-fields obscures unifying themes and cross-cutting challenges. The Handbook consists of 47 chapters in seven parts. Part I sets the stage for the Handbook, identifying overarching issues. Part II offers readers a range of theoretical lenses through which to analyze both the problems facing international environmental law and the solutions it may offer. Part III reviews the treatment of basic issues areas. Part IV analyzes the process of normative development in international environmental law. Part V will assess key theoretical concepts. Part VI examines the roles of various actors and institutions. And Part VII analyzes issues of implementation and enforcement. The Oxford Handbooks series is a major new initiative in academic publishing. Each volume offers an authoritative and state-of-the-art survey of current thinking and research in a particular subject area. Specially commissioned essays from leading international figures in the discipline give critical examinations of the progress and direction of debates. Oxford Handbooks provide scholars and graduate students with compelling new perspectives upon a wide range of subjects in law, humanities and social sciences.

Description

Organizations are a part of everyday life, whether in schools, hospitals, police stations or commercial companies. In this classics text, Charles Handy argues that the key to successful organizations lies in a better understanding of the needs and motivations of the people within them.

Understanding Organizations offers an extended 'dictionary' of the key concepts -- culture, motivations, leadership, role-playing, co-ordinating and consultation -- and then shows how this 'language' can help us find new solutions to familiar problems. Few management writers have been as consistently challenging and influential as Charles Handy. Firmly established as one of the core business texts, this book is essential reading for anyone interested in organizations and how to make them work better.

Combining, clear explanatory text with extracts from a wide range of primary materials alongside practical learning features, this text occupies a unique position within the tort law market as the only Text, Cases and Materials title written for law students at an introductory level. Cases play a pivotal role in shaping tort law, so it's important to read first-hand reports in order to fully understand the subject. A variety of pedagogical features run throughout the text encouraging students to engage in more depth with the subject matter and think critically about complex issues that arise in Tort Law. Think points, exercises, tips, examples, and revision tasks provide plenty of learning support for students whilst key concepts are highlighted for emphasis, and cross-references and comparisons are pointed out to link the various elements of tort law together. Bibliography
The practice of plea bargaining plays a hugely significant role in the adjudication of criminal charges and has provoked intense debate about its legitimacy. This book offers the first full-length philosophical analysis of the ethics of plea bargaining. It develops a sustained argument for restrained forms of the practice and against the free-wheeling versions that predominate in the United States. In countries that have endorsed plea bargains, such as the United States, upwards of ninety percent of criminal defendants plead guilty rather than go to trial. Yet trials, which grant a presumption of innocence to defendants and place a substantial burden of proof on the state to establish guilt, are widely regarded as the most appropriate mechanisms for fairly and accurately assigning criminal sanctions. How is it that many countries have abandoned the formal rules and rigorous standards of public trials in favor of informal and veiled negotiations between state officials and criminal defendants concerning the punishment to which the latter will be subjected? More importantly, how persuasive are the myriad justifications that have been provided for plea bargaining? These are the questions addressed in this book. Examining the legal processes by which individuals are moved through the criminal justice system, the fairness of those processes, and the ways in which they reproduce social inequality, this book offers an ethical argument for restrained forms of plea bargaining. It also provides a comparison between the different plea bargaining regimes that exist within the US, where it is well-established, England and Wales, where the practice is coming under considerable critique, and the European Union, where debate continues on whether it coheres with inquisitorial legal regimes. It suggests that rewards for admitting guilt are distinguished from penalties for exercising the right to trial, and argues for modest, fixed sentence reductions for defendants who admit their guilt. These suggestions for reform include discouraging the current practice of deliberate over-charging by prosecutors and charge bargaining, and require judges to scrutinize more closely the evidence against those accused of crimes before any guilty pleas are entered by them. Arguing that the negotiation of charges and sentences should remain the exception, not the rule, it nevertheless puts forward a normative defense for the reform and retention of the plea bargaining system.
